General Terms & Conditions Of Ooredoo Services



Welcome to Ooredoo! When you decide to sign the present contract or activate or use our services, it means that you approved to comply with the General Terms and Conditions of Ooredoo Services. Therefore, kindly read the following terms and conditions thoroughly to understand your legal rights.

Definitions:

  • Ooredoo: National Mobile Telecommunication Company, telecommunication services provider. in
  • Subscriber (You): The person or party that concludes an agreement with Ooredoo .
  • SIM Card and E-SIM: It is the main communication component part provided by Ooredoo allowing the subscriber to benefit from the service of Ooredoo.
  • CITRA: Communication & Information Technology Regulatory Authority.
  • Contract: It is the paper or electronic form signed by the subscriber in order to ask for or activate the service of Ooredoo, by the subscriber or written applications or approvals made through the electronic devices (phone call or SMS or website) or other registered communication mean.
  • Service: Any service (services) – including but not limited to – (phone calls, local and international messages, and data) provided by Ooredoo directly to its subscriber through Ooredoo branches or one of its authorized distributors or through its website and ooredoo mobile app.
  • Fees: It is the prices list set by Ooredoo including the special conditions and provisions of the service. The aforementioned definitions shall constitute an integral part of the present contract. The following articles shall form the provisions of the contract concluded with the subscriber regarding the service of Ooredoo in addition to any program, content or device related thereto.

1. Services of Ooredoo:

Ooredoo is a mobile telecommunications provider in the State of Kuwait. Any person or legal entity duly registered in state of Kuwait which may benefit from ooredoo’s services in exchange for the agreed fees upon in the contract.

However, Ooredoo does not warrant or represent that it can provide its services everywhere in the State of Kuwait. As well as, Ooredoo shall not be held liable for any problem, delay, failure or interruption occurring in the network at any time For any reasons beyond the Company's control or when maintenance or network repairs are required Ooredoo shall not be obliged to pay any damages for any loss borne by the subscriber as a result thereof. As well as, Ooredoo shall not be held liable for any error or failure occurred in any part of the subscriber’s device and. The devices warranty conditions shall be applied in this regard if any.

2. Fees:

Ooredoo shall be entitled to impose the following fees:

  • Operation fees are the fees imposed to obtain the SIM Card or E-SIM .
  • Subscription fees are the fees paid on a regular basis or/in advance as defined by Ooredoo.
  • The fees of the service used by the subscriber in return of a cost unit specified in accordance with the tariff system of Ooredoo.
  • Roaming fees refer to the service used by the subscriber outside the State of Kuwait.
  • Administrative fees are the fees imposed in case of a settlement delay, service cancellation or amendments made to the contract.(in compliance with the instructions and approvals issued by relevant authorities)
  • Note: Any adjustment of the fees shall be binding and effective for every subscriber once it is published by different media means or on the website of the Company or Ooredoo app.

3. Issuance of Bills:

Ooredoo issues a monthly bill in the name of each subscriber including the total due fees. The bill shall include the different fees of the services to which the subscriber subscribed or used during the last months except for the roaming fees and services and other kinds of services to be listed in the bills of (60) days. However, the Customer shall pay all the bills immediately after receiving a notice in this regard in accordance with the bill. The bills of Ooredoo are final and represent the real account and conclusive evidence regarding the due sums to be settled by the subscriber unless the latter files a complaint pursuant to article (16).

4. Payments:

  • Postpaid: The subscriber shall settle the entire monthly bill on its maturity date whereas the subscriber is held solely liable in this regard. In the event the subscriber abstained or failed to settle the bill on its maturity date, Ooredoo reserves the right to suspend the services of the subscriber until the complete settlement of the due bills. Ooredoo reserves the right to terminate the contract and reallocate the phone number to another subscriber .

    Ooredoo also shall be entitled to collect all the due sums including but not limited to the administrative and judicial fees .

  • Prepaid: The service shall remain valid as long as it is recharged. Each recharge operation shall be related to its validity term whereas the last day of the validity term shall be the expiry date. The expiry date shall be followed by a grace period estimated by the Company provided that it shall not be less than (60) days during which the subscriber shall recharge the account or else the subscriber may lose the line . Ooredoo reserves the right to reallocate the line in accordance with its internal policy. and In the event that the number is not recharged by the subscriber after the activation date, the grace period shall not be less than thirty (30) days for the prepaid lines .

The subscriber shall not be entitled to claim any remaining account whereas the account is owned by Ooredoo

5. Using Ooredoo Services and Devices:

The subscriber agrees to use the service of Ooredoo on its own liability. The subscriber shall not be entitled to use or try to use or delegate others to use the service or devices provided by Ooredoo in any way which may lead to the following:

  1. Violating the law and/or conditions and provisions of the present contract concluded with Ooredoo.
  2. Annoying authorities or destabilizing security.
  3. Sending, receiving, uploading or using any material which violates the public order and rules of conduct or harms the reputation and honor or any information which may form a wrong belief leading to deception and fraud
  4. Affecting the provision of the service to the subscribers of Ooredoo in a negative way.
  5. Violating the copyrights or other intellectual rights.
  6. Accessing or trying to access computer systems, networks or any other information resource illegally or without the approval of the owner of the information or resources.

Ooredoo also has the right to recover the costs, amounts, and compensation incurred as a result of the subscriber’s misuse of the services provided.

6. Fair Usage Policy:

All the unlimited subscribers of Ooredoo services shall be subject to the Fair Usage Policy in accordance with CITRA Regulations

7. Termination:

Once the subscriber activates the SIM Card or subscribes at the service, he/she shall be entitled to ask for the termination of the Contract. As a result thereof, Ooredoo reserves the right to impose convenient fees equal to the due sum and cancellation fees of the Contract in addition to any due fees related to other offers included in a the same Contract.

8. Eligibility:

The subscriber shall prove his/her age and identity by submitting identification documents in accordance with the Subscriber Data Registration Regulations issued by CITRA or any procedure required by Ooredoo .

9. Termination or suspention

First: Termination and/or suspention Right of Ooredoo:
Ooredoo shall be entitled to terminate or suspend the contract in one of the following cases:

  • In case Ooredoo finds that the information included in the contract are incomplete or wrong or fraudulent.
  • In case the subscriber used equipment interfering with Ooredoo network or not found to be in conformity with the internal and international standards.
  • In case the subscriber violates any of the conditions and provisions of the present contract in particular article (5) of the same (Using Ooredoo services and devices).
  • Failure to update the subscriber's data based on Subscriber Data Registration Regulations issued by CITRA.
  • In case of force majeure or national crisis or state of emergency or issuance of a resolution made by the competent authorities binding Ooredoo to suspend or terminate its services.
  • In case there is any due amount related to the subscriber. Ooredoo reserves the right
  • Collection of all due sums and administrative fees from the subscriber or third parties– including but not limited to – (Heirs, Guardian, Trustee etc.) in accordance with the Legal regulations applicable in this regard
  • Second: Termination Right of the subscriber:
    In the event the subscriber asks to terminate the contract or transfer the number to another operator, Ooredoo shall be entitled to impose convenient fees equal to the due sum of the usage and cancellation fees of the Contract in addition to any due fees or numbers’ value or devices related to other offers included in the same Contract.

10. Numbers Portability/ Transfer:

In the event the line will be transferred to another operator during the commitment period to any of the services or offers, the subscriber shall settle the remaining monthly subscriptions and the discount value of the line in addition to the remaining installments of the monthly line value (if any) in accordance with the contract terms signed by the subscriber.

11. Phone Numbers and Transferability to Others:

  1. In the event the line will be transferred to another operator during the commitment period to the cash offer, the subscriber shall settle the remaining monthly subscriptions value and the discount value of the line .
  2. The Parties of the present contract mutually agreed that the subscriber does not own the phone line listed in the present contract whereas he/she shall only be allowed to use it by Ooredoo in accordance with the laws enforced in the State of Kuwait.
  3. The subscriber shall be entitled to transfer his/her phone line to another person in accordance with Legal Regulations and internal procedures applicable in this regard.

12. Personal Information and Data:

  1. The personal information and data required for the Contract are deemed as necessary in order to provide the subscriber with the service. Ooredoo will save, share and use the aforementioned information and data to prepare the service and prepare the bills and respond to the inquiries or available service offers or any other utilizations. Customer hereby acknowledges that he/she/it approved that ooredoo is allowed to share their personal info and Data with third parties in or out-side Kuwait for the purpose of collecting due debts and providing services through a third party .

13. Liability of Ooredoo:

  1. Ooredoo shall be liable for providing the service agreed upon to its subscribers.
  2. Ooredoo shall provide the subscriber with the secret code of the SIM Card which shall be saved in a confidential manner upon concluding the Contract.

14. Liability of the subscriber:

  1. The subscriber shall keep the SIM Card or the Configuration Code of the E-SIM in a good condition and avoid losing or damaging it. He/she shall also keep the secret code confidential and avoid disclosing it before others in any case whatsoever whereas Ooredoo shall not be held liable for any operations or transactions made by others.
  2. The subscriber shall be held liable for using the SIM Card and secret code in person or by others
  3. In the event the subscriber lost the SIM Card or the mobile phone, he/she shall notify Ooredoo immediately by calling the subscriber Service Center of Ooredoo in order to clear his/her liability after suspending the service from the SIM Card.

15. Amendments:

Ooredoo reserves the right to change or amend the provisions of the present Contract from time to time when necessary and after getting CITA required approvals. Any change or amendment shall be binding to the subscriber when published or announced by different media means or company’s websites.

16. Objections and Complaints

The subscriber shall be entitled to object to the monthly due bills or services by submitting a written request to Ooredoo or calling the Customer Service Center on (121) or any other method approved by the company within (28) days from the maturity date of the related bill. In the event of any serious reasons for objection. of any

17. Force Majeure and Out of Control Circumstances

Ooredoo may not be able to comply with the provisions of the present contract or to offer the service due to Out of Control Circumstances including but not limited to the following – act of God, delay or incompliance by others or natural disasters (such as weather, earthquakes, floods, fire) or intended disasters (turbulence, war, civil disturbances, revolutions, properties confiscation, embargo, strikes, electrical defect, governmental procedures or any other resolution made by the competent Court). In such cases, Ooredoo shall not be held liable for not providing the subscriber with the service agreed upon in the Contract. Ooredoo will do everything possible to provide the subscribers with the service as fast as possible.

18. Duration:

The Contract shall remain valid until either party decides to terminate it or replace it with another Contract or amend it in accordance with the enforced law.

19. Applicable Law:

The Contract shall be subject to the laws enforced in the State of Kuwait. Any conflict which may arise in relation hereto shall be referred to the competent Kuwaiti Courts.

20. Preferred Copy:

In the event a contradiction was detected between the Arabic copy and English copy of the present Contract, the Arabic copy shall be prioritized over the English copy.

21. Acknowledgment:

  1. The subscriber acknowledges hereby that he read and understood all the aforementioned articles as well as received the secret code which he/she shall keep confidential on his/her own liability. When the subscriber signs the Contract, it means that he/she found the information included therein provided by the latter to the Company correct, accurate and complete. The subscriber undertakes to inform Ooredoo of any changes of the aforementioned information without any liability on behalf of the latter.
